The current state of IRS enforcement: How to best protect your clients
In April of 2023, the IRS released a robust strategic plan covering fiscal years 2023-2031, which along with other initiatives, provides for enhanced enforcement of the U.S. tax laws. The information provided in this program is not intended to teach specific sections of the U.S. Tax Code. Rather, it provides practical information for non-tax practitioners on how to address their clients’ tax questions and concerns, including potential traps and pitfalls for the unwary. This program covers both civil and criminal IRS investigations as well as civil and post-conviction collection issues. The presenter has been representing taxpayers before the IRS in both civil and criminal matters for over 14 years and is a member of the American Bar Association – Section of Taxation – Civil and Criminal Penalties Committee, which meets annually in Las Vegas for the Tax Fraud and Controversy conference. Too often she sees clients who have been misdirected by well-meaning professionals (not just attorneys) which inspired the development of this presentation.

Geofence warrants
Geofence warrants have proven to be an effective tool to help prosecutors and police make their case, often when no other evidence leads to a suspect. They are the latest intersection between rapidly advancing geospatial technology and law enforcement. In some jurisdictions prosecutors petition judges to authorize warrants which scrutinize one or more international locational databases, containing location records of every citizen in the US with a smartphone. Many legal scholars say it's the details of how those data are obtained from the warrant, selected, processed, and then presented in court which may, or may not, offend long-established Constitutional protections found under the 4th and 5th Amendments.

The right to confrontation: No sick days for the Constitution
The US and Missouri Constitutions guarantee a criminal defendant's right to confront the witnesses against him or her in open court. The pandemic sent courts scrambling for ways to hold trials while protecting litigants, jurors, lawyers, and court staff. Remote appearances by video were quickly adopted, but raised the question of whether a defendant's right to confrontation was satisfied when a witness appeared by video over the defendant's objection. In 2022, in State v. Smith, the Supreme Court of Missouri held that two-way video testimony violates confrontation. Since then, there has been a plethora of litigation concerning confrontation. This session will review the Smith case and opinion, as well as other recent opinions involving confrontation, as well as statutory considerations. In addition, attendees will learn about emerging confrontation issues and receive sample motions to challenge these emerging issues.
